response number for health emergencies. We strongly encourage all users to utilize these resources during any immediate or emergent crisis.
If you have been diagnosed with any of the following mental health conditions:
Schizophrenia (and all other psychotic disorders), Bipolar Disorder (including episodes of mania), Severe Depression with Psychotic Features, Dementias (of all types), or
Delirium, you are required to sign up and access the services of Montherapy through a legally appointed guardian. This measure is in place to ensure that you receive the appropriate support and care during your therapy sessions. By using Montherapy's services, you acknowledge and agree to this condition and understand that your guardian will be involved in the process as necessary.
These Terms govern your access to and use of the communication platform provided by Montherapy ("we," "our," "us") in connection with our online therapy services available via the Montherapy website at www.Montherapy.com ("Website") and the Montherapy mobile app ("App"), which available on the website of Montherapy and Apple App Store and Google Play Store respectively (collectively referred to as "Montherapy" or the "Service(s)"). These Terms also apply to any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Service (collectively referred to as "Content").
By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree to all of these terms and conditions, you are not authorized to use the Service. The terms "you," "your," and "yourself" refer to the individual user of the Service.
These Terms are between you and Montherapy, not with any App Provider (such as the Apple App Store, Google Play Store, or other similar platforms) where the App may be available. The App Provider is not responsible for providing any maintenance or support services for the App.
Montherapy will provide you access to a list of third-party individual consultants who are psychologists and psychiatrists. Both can act as therapists, but there are key differences in their roles and training.
You understand that a psychologist typically holds a doctoral degree in psychology (Ph.D. or Psy.D.) and specializes in therapy and counselling. They use talk therapy (like cognitive-behavioural therapy) to treat emotional and mental health issues but generally cannot prescribe medication (except in a few regions with special training). Whereas psychiatrists are medical doctors (M.D. or D.O.) who specialize in diagnosing and treating mental health conditions. They often focus more on the biological aspects of mental illness and can prescribe medications, such as antidepressants or antipsychotics. Psychiatrists may also offer therapy but often work alongside psychologists or other therapists to provide comprehensive care. You therefore understand that while both can be therapists, psychiatrists focus more on medication management, and psychologists primarily provide talk therapy. Hence you agree to use the services responsible and understand that by wrongly representing your mental status to a psychiatrist you will abuse the system for which you will be banned and solely responsible for all the legality.
Emergency Contact Details
You agree to provide "Emergency Contact Detail" (name and telephone number) for a personal contact and/or close family member while registering for psychiatric sessions on the Montherapy website or app, which is to be used in the event of a mental health crisis or other emergency where your location must be known. Additionally, you agree to obtain their consent before sharing their contact information with your Assigned Therapist.
You understand that your access to and use of the Service depends on the accuracy of the information you provide, including your age, residence, and Emergency Contact Information. The Providers ("Provider(s)") you interact with rely on this accurate information to deliver the Services to you.
By subscribing to our Services, you agree to these Terms and acknowledge that we will
manage the information you provide in accordance with our Privacy Policy, available
on our website and app which may be updated from time to time through an email
notice on your registered email and popup screen on the app.
Account Eligibility and Enrollment
To access the Services, you must first enrol and create an individual user account
("Account") by providing certain information as outlined in our Privacy Policy. For
privacy reasons, you may use a proxy name during psychological therapeutic sessions;
however, YOU MUST NOT USE A PROXY NAME FOR PSYCHIATRIC THERAPEUTIC
SESSIONS WITH A PSYCHIATRIC and therefore use your real name and inform or use a
guardian where applicable as referred to guardian required category above. You agree
not to create more than one Account or create an Account on behalf of someone else
without their explicit permission.
By using the Service, and to enable Providers to communicate with you, you agree to:
Provide true, accurate, current, and complete information about yourself as
prompted during the Account enrollment process for sessions with the
psychiatric / Psychiatric Therapeutic Sessions (noting that a nickname would
be used during therapy sessions);
Maintain and promptly update your Account details each time you log in to
ensure they remain true, accurate, current, and complete. If you provide
information that is untrue, inaccurate, outdated, or incomplete, or if
Montherapy has reasonable grounds to suspect such inaccuracies,
Montherapy reserves the right to stop your therapy sessions of Montherapy or
take other appropriate actions that may lead to a permanent or temporary ban
on the account and no refund would be provided against such a breach.
Certify that you are:-
i. over the age of eighteen (18), and have the legal ability to consent to
our Services or have obtained Parent/Guardian consent or the
Guardian is creating and moderating your account on their behalf,
and
ii. physically located in or a resident of Pakistan when creating your
Account.
Remain responsible for maintaining the confidentiality of your Account
password and username (if applicable), as well as any other security-related
information associated with your Account. Montherapy will not be liable for any
loss you incur due to unauthorized access or use of your Account, whether with
or without your knowledge. Additionally, if your smartphone, tablet, computer,
laptop or any other device that is used to access Montherapy services is stolen,
lost, misplaced or out of access, it is your responsibility to immediately change
the password to secure your account, if any unauthorized use or activity takes
place you will be whole and solely responsible for such utilization.
You must not use it for psychiatric sessions or grant access to a therapist to
anyone besides yourself, if such access is granted you will be banned from the
services and your account will be permanently suspended.
You must not use it for psychiatric sessions or grant access to a therapist to
anyone besides yourself to attain medical prescriptions, if such access is
granted you will be banned from the services and your account will be
permanently suspended.
Any medical prescribed to you by the psychiatrist are sole and purely your use
alone and under no circumstances would be shared with anyone or abuse of
dosage, if such use is done you will sole and wholly be responsible for such
actions.
Acceptable Use
You agree not to access or use the Services in any unlawful manner or for any unlawful
or illegitimate purpose or any misuse or abuse and you will comply with these Terms at
all times. Specifically, you shall not post, use, store, or transmit any of the following:
Any message or information under a false name;
Information that is:-
i. unlawful,
ii. libelous,
iii. defamatory,
iv. abusive,
v. vulgar,
vi. obscene,
vii. racist,
viii. fraudulent,
ix. predatory toward minors,
x. harassing,
xi. threatening,
xii. or hateful to any person;
Unsolicited emails, advertisements, or promotions of goods and services;
Any content that may cause harm to a third party;
Any content that could constitute, encourage, or result in criminal activity or
violate any applicable law;
Information that infringes or violates the intellectual property rights, privacy
rights, or publicity rights of others.
You shall not attempt to disrupt the operation of the Service by any means, including
but not limited to, using viruses, Trojan horses, worms, time bombs, keystroke loggers,
spyware, adware, denial-of-service attacks, flooding, or spamming.
You shall not use the Service in any way that could damage, disable, or impair the
Service.
You shall not attempt to gain unauthorized access to any user accounts, computer
systems, or networks through hacking, password mining, or any other methods. You
shall not use any robots, scrapers, malicious code, or other tools to access the Service
for any purpose. Montherapy and its affiliates are not obligated to respond to
messages posted on the Service. You are solely responsible for the information or
materials you post on the Service.
If you download the App, you agree that the software may periodically require you to
download upgrades, updates, and additional features that we release to improve,
enhance, and further develop the software, Service, or App.
You shall not attempt or record, cast, publish, post, screen record or any other way of
reproduction of session, such actions are prohibited.
Payment
You agree to pay all fees and charges associated with your Account in a timely manner,
according to the package you choose—whether two-week or monthly sessions—and in
line with the terms and rates published by Montherapy, which may be updated
periodically. These fees and charges (including applicable government taxes and late
fees) will be charged to the payment method you provided during your Account setup.
You agree to make payments exclusively through the JAZZ CASH by Mobilink
Microfinance Bank Ltd, payment option, the only authorized payment platform used by
Montherapy.
You must not make or request any direct payments to the psychiatrist, psychologist, or
any other individual, such an action would result in a permanent ban. If you are asked
to make such a payment, you must immediately inform Montherapy customer support.
If a payment is made from an account other than your own, you affirm that the
payment is authorized by you.
If you access the Services through an insurance-backed plan, your payment will be
managed by a third-party "Payor," which administers or insures the benefit program
provided by your employer. Your co-payments, coinsurance, or deductible may be
automatically charged at the beginning of the session period or after your insurer
processes the claim.
Providers
You are strongly encouraged to exercise caution and sound judgment when making
any mental health or medical decisions. Never ignore, delay, or avoid seeking medical
advice from your primary doctor or another qualified healthcare provider, nor should
you rely solely on Montherapy without considering traditional face-to-face
appointments, just because of something you read on the Website or App or advice
received from a Provider.
Montherapy supports a holistic approach to mental health, empowering you to make
informed choices that create the best therapeutic journey tailored to your individual
needs. If your Provider does not meet your expectations, you have the option to switch
to a different Provider at any time.
Except for the guidance and advice provided directly by your Provider, the graphics,
educational resources, and other incidental information on the Website or in the
Content should not be considered medical advice. It is important to consult with a
qualified healthcare professional for diagnosis and treatment, including advice on
which medications or treatments may be appropriate for you.
None of the Content guarantees that any specific medication or treatment is safe,
suitable, or effective for your needs. While Montherapy does not endorse any specific
tests, medications, products, or procedures, psychiatrists may prescribe medication if
deemed necessary, which will be dispensed by a third-party vendor.
Montherapy reserves the right to define the scope of clinical practice it provides with
the assistance of individual consultants who are the therapists.
Intellectual Property
All Content accessible through the Service is owned by Montherapy or its licensors and
is protected by copyright, trademark, patent, trade secret, and other intellectual
property laws. You agree not to reproduce, modify, retransmit, distribute, sell, exploit,
publish, broadcast, or share the Content received through the Service with any third
party. All software and related documentation available for download from the Service
are copyrighted works belonging to Montherapy or its licensors. Any copies made of
information obtained through the Service must include all relevant copyright notices.
The terms "Montherapy," "Messaging Therapy," and "Live Video Sessions" are
copyrighted, with all rights reserved. Subject to the terms of this Agreement,
Montherapy grants you a limited, revocable, non-transferable, and non-exclusive
license to use the software, network facilities, content, and documentation within the
Service solely to the extent necessary to access and use the Service.
This license does not allow you to, and you agree not to:
Modify, translate, reverse engineer, disassemble, decompile, or create
derivative works of the Service, nor permit a third party (directly or indirectly,
including through the use of wizards, agents, bots, or other tools) to do so; or
Transfer, distribute, sell, lease, rent, disclose, or provide access to the Service
to any third party, or use the Service to offer service bureau, time-sharing, or
other services to third parties.

ACCESS TO THE SERVICE AND THE INFORMATION PROVIDED IS OFFERED "AS IS"
AND "AS AVAILABLE." SOME JURISDICTIONS MAY OFFER CERTAIN WARRANTIES,

THE SERVICES, INCLUDING THEIR RELIABILITY, COMPLETENESS, SECURITY,
QUALITY, ACCURACY, AVAILABILITY, OR SUITABILITY FOR YOUR NEEDS. YOU
EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE AND YOUR RELIANCE ON ANY
OF ITS CONTENTS IS AT YOUR OWN RISK. BY USING THE SERVICES, YOU
ACKNOWLEDGE THAT, EXCEPT FOR THE GUIDANCE AND ADVICE RECEIVED
DIRECTLY FROM YOUR PROVIDER, THE SERVICES DO NOT CONSTITUTE HEALTH OR
MEDICAL ADVICE.
YOU AGREE THAT YOU ARE RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY
OF YOUR PASSWORD AND ANY OTHER SECURITY INFORMATION RELATED TO YOUR
USE OF MONTHERAPY. YOU ALSO AGREE TO IMMEDIATELY NOTIFY MONTHERAPY OF
ANY UNAUTHORIZED USE OF YOUR USERNAME OR PASSWORD.
YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO THE SERVICE OR ANY
COMPUTER SYSTEM, ANY LOSS OF DATA, OR ANY IMPROPER USE OR DISCLOSURE
OF INFORMATION ON THE SERVICE CAUSED BY YOU OR ANYONE USING YOUR
USERNAME OR PASSWORD. MONTHERAPY CANNOT AND DOES NOT ACCEPT
RESPONSIBILITY FOR ANY LOSS, DAMAGE, OR LIABILITY RESULTING FROM THE
FAILURE OF TELECOMMUNICATIONS INFRASTRUCTURE, THE INTERNET, OR YOUR
MISUSE OF ANY PROTECTED HEALTH INFORMATION, ADVICE, IDEAS, INFORMATION,
INSTRUCTIONS, OR GUIDELINES ACCESSED THROUGH THE SERVICE.
Limitations of Liability; Indemnification
EXCEPT WHERE PROHIBITED BY LAW, MONTHERAPY WILL NOT BE LIABLE FOR ANY
INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES
ARISING FROM YOUR USE OF THE SERVICES OR ANY THIRD PARTY’S USE OF THE
SERVICES, TO THE MAXIMUM EXTENT PERMITTED BY LAW. THIS INCLUDES BUT IS
NOT LIMITED TO, DAMAGES SUCH AS LOST PROFITS, LOSS OF DATA, COMPUTER
FAILURE, OR VIOLATION OF YOUR RIGHTS BY ANY THIRD PARTY, EVEN IF
MONTHERAPY HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES,
REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED. IN CASE OF
ANY ISSUE WITH THE SERVICE, ITS CONTENT, OR IN CONNECTION WITH YOUR USE
OF THE WEBSITE, APP, OR SERVICES, OR ARISING OUT OF THESE TERMS, YOU AGREE
THAT MONTHERAPY’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL
DAMAGES, LOSSES, OR CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR
OTHERWISE) WILL BE LIMITED TO RS. 1000, UNLESS OTHERWISE REQUIRED BY LAW.
UNDER NO CIRCUMSTANCES WILL MONTHERAPY, ITS LICENSORS OR SUPPLIERS,
OR ANY THIRD PARTY PROMOTING THE SERVICE OR PROVIDING YOU WITH A LINK TO
THE SERVICE BE LIABLE FOR YOUR USE OF THE SERVICE OR ANY CONTENT WITHIN
IT. THIS INCLUDES BUT IS NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN
CONTENT, ANY INFRINGEMENT OF THIRD-PARTY INTELLECTUAL PROPERTY OR
OTHER RIGHTS, OR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF USING ANY
CONTENT.
Some jurisdictions may not allow the exclusion of certain warranties or limitations of

Any link (including hyperlinks, buttons, or referral tools of any kind) provided within the
Service is intended for your convenience. The presence of a link does not imply
endorsement, recommendation, or certification by Montherapy, nor should it be
interpreted as an indication that any third-party website is affiliated with Montherapy.
Montherapy does not endorse the content found on third-party websites and is not
responsible for the content or accuracy of linked third-party websites or
advertisements. Montherapy makes no claims regarding the content of such sites and
does not knowingly link to sites that infringe on valid trademarks, service marks,
copyrights, or patents. Your use of third-party websites is at your own risk and is
governed by the terms and conditions of those websites.
Complaints
Montherapy has designed a mechanism for complaint management under which you
can submit a complaint relating to any issue that you face, which will be dealt with by
the support team in an autonomous manner and will settle the matter within 14 days,
in case of no settlement, a mediation session would be conducted by appointment of
professional mediators within 15 days, if still remains unresolved the parties may go
into arbitration.
Termination
Montherapy reserves the right but is not obligated, to deny access to the Service to any
individual, agency, or organization for illegal or inappropriate use, nonpayment, or
other significant misuse. Additionally, Montherapy may modify, suspend, or terminate
all or part of the Service, either temporarily or permanently, without prior notice.
Support Terms
Montherapy provides various support options to assist you with navigating the platform
and our services ("Support"). To request Support, please use the online web form
available on our website. If additional help is needed, you can contact Montherapy via
phone or online chat. To ensure effective troubleshooting, you are expected to
cooperate reasonably with Montherapy.
For security reasons, please avoid sharing sensitive personal information when using
these support systems. Any information provided in Support requests may be
accessed by individuals assisting you, including through third-party support ticketing
systems. Therefore, do not include credit card details or other sensitive data in your
communications with Montherapy. Support requests are not intended for medical
advice or emergency situations. Comments provided in response to Support requests
should not be interpreted as medical care. In case of a life-threatening emergency,
please call 1122 or use other immediate resources for help.
By registering for, accessing, and/or using Support, you agree to adhere to
Montherapy's terms of use and consent to the storage of information related to your
Support requests through a third-party ticketing system. Please note that by submitting
a Support request, Montherapy may access your User Account.
You understand and agree that Montherapy is a platform service provider and all
therapists are individual consultants who have voluntarily offered their service through
Montherapy.
Promotions & Trial Subscriptions
To redeem your coupon or voucher code, you must provide Montherapy with the
requested coupon or voucher information. Promotional offers may not be combined
with other promotional offers associated with any account that you own, unless
otherwise expressly permitted in the applicable terms associated with each
promotional offer (“Promotional Terms”). Montherapy reserves the right, in its sole and
absolute discretion, to determine your eligibility for any promotional offer pursuant to
the applicable Promotional Terms. Montherapy reserves the right to change, amend
and alter then-current promotional offers or Promotional Terms as well as institute
new promotional offers, from time to time and at any time, in its sole and absolute
discretion. Montherapy does not guarantee that any promotional offers are or will be
available to you at all, or in connection with any services desired by you.
From time to time, Montherapy may offer a Trial Subscription (“Trial Subscription”) to
receive introductory services. You may only receive one Trial Subscription. Without
limitation, any attempt by You to receive more than one Trial Subscription, such as by
creating alternate accounts, will be considered a material breach of these Terms.
Refunds
The Montherapy shall not provide any refunds for services rendered by you (customer).
If you have concerns about the service provided, you shall inform the Montherapy customer service that there has been a disparity in the service and you will be signed to a new therapist. If you wish to not avail of the service for that particular time, in the event you are required to put forward a request for account credit. Montherapy will credit the remaining hours to your account subject to acceptance of the request.
This account credit may only be used for future services offered by Montherapy. Your account credit must be utilized within 60 days from the date it is issued. If you do not avail within this time period, the credit will automatically expire and will not be subject to renewal or extension.
Governing Law & Disputes
PLEASE READ THIS SECTION CAREFULLY. BY AGREEING TO THIS, THE COMPANY CONSENTS TO RESOLVE ALL DISPUTES WITH MONTHERAPY THROUGH BINDING INDIVIDUAL ARBITRATION. THIS AGREEMENT ALSO INCLUDES A WAIVER OF THE RIGHT TO PARTICIPATE IN ANY CASE BEFORE THE CIVIL COURTS OF PAKISTAN.
The Montherapy and you agree to settle all disputes amicably between you and the Montherapy (i.e. Montherapy Tech (Private) Limited and its subsidiaries or its affiliates).
Primarily the matter will be settled by way of mutual settlement, for which you have to write to the customer support addressing the issue and the customer support will take up the complaint and propose a solution within 14 days. If the dispute is not resolved then the arbitrator will settle the dispute and grant a binding award.
In accordance with the Arbitration Act, 1940 (Pakistan), any dispute or claim arising out of or relating to your use of the Services, including but not limited to the application, enforceability, scope, or interpretation of these Terms, shall be resolved through binding arbitration, rather than through court proceedings. The arbitration will be conducted by a sole arbitrator appointed under the provisions of the Arbitration Act, of 1940, and the arbitration proceedings will take place in Islamabad, Pakistan.
The party initiating the arbitration (the claiming party) shall bear the costs of the arbitration unless the arbitrator decides otherwise. The decision of the arbitrator shall be final and binding on all parties, with limited grounds for judicial review as provided under the Arbitration Act, of 1940.
Arbitration proceedings shall be conducted in accordance with the rules and procedures applicable under Pakistani law, and the arbitrator shall have the authority to award the same relief or damages as a court (including injunctive and declaratory relief or statutory damages). Both parties agree to abide by the arbitrator's decision, which shall be enforceable as a legal judgment.
If any of these provisions conflict with the governing arbitration law or procedural rules, the Arbitration Act, of 1940 shall prevail.
YOU AND MONTHERAPY EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, GROUP, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND MONTHERAPY EACH WAIVE ANY RIGHT TO A JURY TRIAL. YOU AND MONTHERAPY ALSO BOTH AGREE THAT NOTWITHSTANDING OUR AGREEMENT TO ONLY ARBITRATE DISPUTES AS STATED ABOVE, YOU OR WE MAY BRING SUIT IN COURT TO ENJOIN INFRINGEMENT OR OTHER MISUSE OF INTELLECTUAL PROPERTY RIGHTS.
If this arbitration provision is found to be null and void, then all disputes arising under the Terms between us will be subject to the jurisdiction of Islamabad, Pakistan, and you and we hereby submit to the personal jurisdiction and venue of these courts. You and Montherapy agree that if for any reason a dispute proceeds in court rather than
arbitration:
i) the dispute will proceed solely on an individual, non-class, nonrepresentative basis; and
ii) neither you nor Montherapy may be a class representative or class
member or otherwise participate in any class, representative,
consolidated, or private attorney general proceeding.
This agreement to arbitrate does not prevent you or Montherapy from seeking provisional remedies in support of arbitration, including but not limited to court orders to stay a legal action, compel arbitration, or confirm an arbitral award, from a court of competent jurisdiction. Additionally, this agreement does not prevent you or Montherapy from (i) applying to the appropriate court for a temporary restraining order, preliminary injunction, or other interim or conservatory relief as necessary, or (ii)
seeking relief in any court for disputes related to a violation or potential violation of Montherapy's intellectual property rights.
